1. Agreement to Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you ("Merchant," "you," or "your") and AmanExchange ("AmanExchange," "we," "our," or "us") governing your access to and use of our payment gateway services.
By creating an account, accessing our API, or using any of our services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use our services.
2. Services Provided
AmanExchange provides payment processing services that enable you to:
Accept online payments from customers in Iraqi Dinar (IQD)
Process credit and debit card transactions
Receive payment settlements to your Iraqi bank account
Access payment analytics and reporting tools
Integrate payments via our API and SDKs
Manage refunds and disputes
3. Eligibility
To use our services, you must:
Be a registered business entity in Iraq
Be at least 18 years old or the legal age of majority
Have a valid Iraqi bank account
Provide accurate and complete business information
Comply with all applicable Iraqi laws and regulations
Not be on any sanctions or restricted parties list
We reserve the right to refuse service to any merchant at our sole discretion.
4. Account Registration and KYC
To register for an account, you must:
Complete our registration form with accurate information
Submit required documentation for KYC verification
Undergo identity and business verification
Agree to Central Bank of Iraq compliance requirements
You are responsible for maintaining the confidentiality of your account credentials and API keys. Any activity under your account is your responsibility.
5. Fees and Pricing
Our pricing is transaction-based with automatic tier upgrades:
Starter: 2.9% + 500 IQD per successful transaction (up to 1,000 transactions/month)
Business: 2.5% + 400 IQD per successful transaction (up to 10,000 transactions/month)
Enterprise: Custom pricing (unlimited transactions)
Fees are deducted from transaction amounts before settlement. We reserve the right to modify our pricing with 30 days' notice.
6. Payment Settlement
Settlement terms:
Settlements are processed to your registered Iraqi bank account
Standard settlement period is T+3 business days
Settlement may be delayed for fraud review or disputes
We may hold a rolling reserve for risk management
Minimum settlement amount is 10,000 IQD
7. Prohibited Activities
You may not use our services for:
Illegal goods or services
Adult content or gambling (without explicit approval)
Money laundering or terrorist financing
Fraudulent or deceptive practices
Sale of counterfeit goods
Pyramid schemes or multi-level marketing
High-risk pharmaceuticals or controlled substances
Any activity that violates Iraqi law
Violation of these restrictions may result in immediate account termination and withholding of funds.
8. Refunds and Chargebacks
You are responsible for:
Clearly communicating your refund policy to customers
Processing legitimate refund requests promptly
Responding to chargeback notifications within required timeframes
Maintaining documentation to defend against chargebacks
Excessive chargebacks (over 1% of transactions) may result in higher fees or account restrictions.
9. API and Integration
When using our API:
Keep your API keys secure and confidential
Do not exceed rate limits specified in documentation
Use sandbox environment for testing
Properly handle webhooks and implement retry logic
Display AmanExchange branding on checkout pages
Comply with PCI DSS requirements
10. Data and Privacy
You agree to:
Comply with Iraqi data protection laws
Obtain necessary consents from customers
Not store sensitive card data on your systems
Report security breaches immediately
Use customer data only for legitimate business purposes

11. Compliance and Regulatory
You must:
Comply with Central Bank of Iraq regulations
Cooperate with AML/CTF investigations
Provide requested documentation within specified timeframes
Report suspicious transactions
Maintain accurate business records
12. Account Termination
We may suspend or terminate your account:
For violation of these Terms
If we suspect fraudulent activity
For excessive chargebacks or refunds
If required by law or regulatory authorities
At our sole discretion with notice
You may close your account at any time with 30 days' notice. Upon termination, pending settlements will be processed according to our standard timeline.
13. Limitation of Liability
To the maximum extent permitted by law:
We are not liable for indirect, incidental, or consequential damages
Our total liability shall not exceed fees paid by you in the past 12 months
We are not responsible for losses due to service interruptions or technical issues
You indemnify us against claims arising from your use of our services
14. Modifications to Terms
We may modify these Terms at any time. Material changes will be communicated via:

Dashboard notification
Website announcement
Continued use of our services after changes take effect constitutes acceptance.
